Board denies 12-unit residential variance for White Oaks Road

NH LACONIA — Laconia Zoning Board denies 12-unit residential variance on rural road. The Board unanimously rejected a proposal to develop 12 single-family homes on approximately 10 acres at 238 White Oaks Road, finding the applicant failed to meet the unnecessary hardship criterion required for a variance. Chair Marcia Hayward and fellow members cited New Hampshire case law holding that financial feasibility and development cost do not constitute hardship and that the property can be reasonably used under existing zoning.
The Board also denied two short-term rental variances citing the same hardship standard, while approving four variances for a shoreland replacement home that reduces impervious coverage from 37 percent to 30 percent.
